EB5 Regional Center Vs. Individual EB5 Project, Immigration Lawyer in California


Hi, this is Jacob Sapochnick, an immigration
attorney based in San Diego. And in this video, I want to explain about
the EB5 investor visa and the difference between a regular EB5 and the Regional Center. Many of our site visitors and our Facebook
fans are asking about what are the differences between the two categories of the EB5? Well, the regional center is a program created
in the 90s, allowing a foreign investor to put money in a government-approved program. There are more than 200 of them all over the
US. Where you put the money in a government-approved
project and obtain a green card within a year, a conditional green card, and then you remove
the conditions after two years and get a permanent green card. And there is a possibility as well, maybe
after five, six years, to exit the project and return the funds. And that’s called the Regional Center where
the investor is not required to live or work in their project and not even reside in the
same state where the project is operating. A traditional EB5 typically requires $1 million
or half a million if it’s invested in a targeted area where the investor must invest in their
own project. It was a restaurant or hotel or a factory,
create 10 full-time jobs of US citizens and other requirements to satisfy that project. It’s a much more riskier route because there
is no guarantee that your own project is going to succeed all the way through for you to
be able to remove the conditions. Nevertheless, there are many investors who
know what they want, they have the funds, they want to create their own projects, and
we strongly encourage them to do the due diligence as to the location and the size of the project
to make sure that they are able to satisfy all the requirements of the traditional EB5. Most investors right now are looking for an
easy way just to get a green card. And they’re really looking into the EB5 Regional
Center project, which does not require active involvement. It’s only half a million, can be anywhere
in the US. It’s a pretty straight forward way to obtain
a green card, whether it’s for your child or for you if you want to move here with your
family and settle in the US. And so, it’s really, the main distinction
between the regional center EB5 and the traditional EB5, where you invest in your own project,
which typically, it’s at least a million most industrial areas. If you have any questions, please post them
